The Evidence Standard
When a regulator opens an inquiry into an AI deployment, they do not ask to see your compliance policy. They ask to see evidence. Specific, retrievable, contemporaneous evidence that the requirements were met — not evidence that you intended to meet them, not evidence that a process existed that should have produced them, but the actual records that demonstrate the regulated behavior occurred.
This distinction — between compliance posture and compliance evidence — is where most AI deployments fail. Organizations have invested in the former without building the latter. They have policy documents, governance frameworks, and legal sign-off. They do not have the infrastructure that produces the records those policies describe.
Two months into the dual Colorado/EU enforcement window, the organizations discovering this are not the ones that ignored the regulations. They are the ones that took the regulations seriously as a legal matter but underestimated what they require as an infrastructure matter.
What Regulators Actually Ask For
Enforcement inquiries under the Colorado AI Act and EU AI Act are structured around specific questions about specific decisions or deployments. The regulator does not audit your policy — they audit your records. Five questions come up in virtually every inquiry in the consequential AI space:
The pattern in this table is consistent. The policy answer describes an intention or a process. The evidence answer names a specific record: who, what, when, linked to what decision. A regulator accepting a policy answer instead of an evidence answer is not conducting a compliance inquiry — they are reading a compliance statement. When they want to verify, they ask for evidence, and the gap between the policy and the record becomes the enforcement exposure.
Why Policies Fail as Evidence
The compliance policy problem is not that policies are dishonest. It is that policies describe intended behavior. Evidence describes actual behavior. The distinction is not semantic. An AI system that is required to log human review decisions will log them correctly if the logging infrastructure exists. If the infrastructure does not exist, the log does not exist — regardless of what the policy says the system should do.
The failure mode is architectural. Organizations deploying AI built the capability layer — the model serving, the API integrations, the output rendering. The governance layer — the contemporaneous records, the decision linkages, the delegation chain tracking — was designed as a future addition. Future additions rarely happen before enforcement begins. They happen after.
An impact assessment conducted three days before an enforcement inquiry, with a retroactive date stamp, is not the same as an impact assessment conducted before deployment. Regulators know this. The document date is not the evidence. The existence of the process before the fact is the evidence. Building backwards is visible.
What Audit-Ready Infrastructure Produces

Contemporaneous capture. Records are created at the time of the regulated event — the decision, the review, the authorization, the notification. Tamper-evident retention. Records that can be modified after the fact are not evidence. The Colorado AI Act does not specify a retention period; the EU AI Act requires logs be retained for 10 years for high-risk systems. Both require that what was retained is what was originally captured.
Where Organizations Stand Now
Two months after the Colorado AI Act's effective date and one month after the EU AI Act's high-risk obligations, the landscape has clarified into three groups.
The first group built compliance infrastructure before the deadlines. They have operational audit trails, documented impact assessments, human oversight mechanisms that produce records, and delegation chain logging. They can answer the five questions. They are not worried about this period.
The second group has compliance posture but not compliance evidence. They have policies, governance documents, and legal sign-off. They do not have the infrastructure. They are discovering this gap now, in the period when enforcement is still new enough that building the infrastructure quickly is possible. For this group, the path forward is clear: build the infrastructure, build it correctly, document when it was built.
The third group is not paying attention. They will encounter enforcement through a consumer complaint, an advocacy organization, or a sector survey. When they do, they will be building infrastructure under the worst conditions.
The dividing line between the first and second groups is not resources or awareness. It is the decision, made before the deadlines, to treat compliance as an infrastructure problem — not a policy exercise. That decision is still available to the second group. For the third, it is running out.
